On May 20th, 2016 the American Immigration Lawyers Association (“AILA”) filed a claim against the United States Citizenship and Immigration Services (“USCIS”) requesting the production of records that explain the application selection process for the H-1B quota applications. These include the intake procedures, reasons for rejection or exclusion of applicants from the lottery pool, how USCIS determines it has received a sufficient number of H-1B petitions to reach the cap, records that explain the lottery process, and how USCIS tracks and counts unused H-1B’s. If the court finds for AILA, USCIS will have to produce evidence explicating how the applications are allocated and tracked.
